Quebec-Ontario Inter Association Mobility Agreement Inter-Provincial Mobility Agreement On June 19, 2003, the Ordre des Géologues du Québec ("OGQ") and the Association of Professional Geoscientists of Ontario ("APGO") signed the Quebec-Ontario Inter Association Mobility Agreement. This agreement provides for reciprocal recognition of Quebec and Ontario registered professional geoscientists to facilitate Incidental and Temporary Practice between the provinces. The following provides information on the agreement, links to the legislation and important references on each of the association's websites and instructions on how members can apply to use the facilities of this agreement. AGREEMENT SUMMARY (RÉSUMÉ DE L'ENTENTE) WORKING OUT OF PROVINCE - Important Notice TRAVAILLER HORS DE LA PROVINCE - Avis important) HOW TO APPLY FOR INCIDENTAL PRACTICE (COMMENT DEMANDER UNE AUTORISATION POUR LA PRATIQUE OCCASIONNELLE) HOW TO APPLY FOR TEMPORARY PRACTICE (COMMENT DEMANDER UN PERMIS POUR LA PRATIQUE TEMPORAIRE) AGREEMENT SUMMARY The Quebec-Ontario Inter Association Mobility Agreement provides for reciprocal recognition of Quebec and Ontario registered professional geoscientists to facilitate Incidental and Temporary Practice between the provinces. Incidental Practice is defined as practice in a specified location which is limited in time and scope to a maximum of three separate incidents within a maximum 3 month combined duration occurring in any 12 month period. This is provided by Special Authorization in Quebec and Special Exemption in Ontario. All visiting practitioners will be required to complete and submit a simple form in duplicate in both the home and host provinces. On confirmation of membership in good standing in the home province (and proof of professional liability insurance coverage, as required), authorization will be granted by the host province. There will be no charge to members to obtain clearance for Incidental Practice. Temporary Practice is defined as practice which exceeds Incidental Practice but does not exceed 12 months in duration and is related to a particular engagement. Temporary practice will require applying for a license in the host jurisdiction. Temporary practice licensure will be of one year duration and will be renewable for 2 additional years. RÉSUMÉ DE L'ENTENTE L'Entente bilatérale Québec/Ontario sur la mobilité des géologues/géoscientifiques professionnels définit les termes d'une reconnaissance réciproque des géologues/géoscientifiques professionnels afin de faciliter l'exercice ou la pratique temporaire ou occasionnel dans les deux provinces. La pratique occasionnelle est définie comme un exercice qui n'excède pas trois activités individuelles dans un (ou des) endroit(s) spécifié(s) durant une période de trois mois consécutifs à l'intérieur d'une période de douze mois . Cet exercice est autorisé suite à l'obtention d'une Autorisation spéciale au Québec ou d'une Dispensation spéciale en Ontario. Les professionnels le désirant pourront demander une telle autorisation en complétant un formulaire qui devra être transmis à la province hôte avec copie conforme à leur province d'origine. Sur confirmation de leur statut de membre dans leur province d'origine (et sur production d'une preuve d "assurance responsabilité, le cas échéant) l'autorisation sera émise par la province hôte. Aucuns frais ne sont exigés pour la délivrance d'une telle autorisation. La pratique temporaire est définie comme un exercice excédant les termes de la Pratique occasionnelle et lié à un travail spécifique mais sans dépasser une période de 12 mois. La Pratique temporaire nécessite l'obtention d'un permis d'exercice dans la province hôte. L'autorisation visant La Pratique temporaire sera pour une durée de un an et pourra être renouvelé pour deux années supplémentaires. WORKING OUT OF PROVINCE - Important Notice En Francais Because of the overarching responsibility of the associations to ensure the protection of the public in each of the provinces at all times, it is a requirement that any member of either association operating in the other jurisdiction be aware of and comply at all times with all laws, regulations and guidelines that pertain to the practice of the profession of geoscience and the protection of the public and the physical environment in both jurisdictions. O.Reg 60/01 Section 6 (2) of the Code of Ethics of Professional Geoscientists of Ontario under the Professional Geoscientists Act, 2000 states: "A professional geoscientist shall comply with all applicable laws of any jurisdiction where work is performed or where a report or an opinion is provided on geoscientific matters." Likewise the Code in Quebec states: "The Geologist is conscious of legal, material, social and ethical obligations which his professional actions may entail and of the potential consequences of his work, his declarations and his writings on his client, his profession and the public at large. The Geologist practicing outside Quebec is expected to abide by the ethical standards and rules of the territory of his practice while abiding by the Code of ethics of OGQ". TO PRACTICE IN ONTARIO All those practicing professional geoscience in Ontario are required to operate under the provisions of the Professional Geoscientists Act, 2000, the regulations and by-laws under this Act and all other pertinent legislation. The APGO is also in the process of developing Professional Practice Guidelines for each of the disciplines of geoscience and each of the principal areas of practice. It is the duty of all professionals practicing in the province to be fully aware of and adhere to these guidelines at all times. HOW TO APPLY FOR INCIDENTAL PRACTICE En Francais Incidental Practice is defined as practice in a specified location which is limited in time and scope to a maximum of three separate incidents within a maximum 3 month combined duration occurring in any 12 month period - "the 3+3 in 12 rule". This is provided by Special Authorization in Quebec and Special Exemption in Ontario. All visiting practitioners will be required to complete and submit an Application for Incidental Practice form. This bilingual form will require that you provide basic information on yourself and the assignment you are to engage upon, including the location of the work, the client, and the commencement date. Upon completion and signature, the form should be sent along with current photo ID by mail, fax or as an electronic file in duplicate to both your home association and the host association in whose jurisdiction you intend to work. NOTE: if you fax or e-mail the form you must also send the original signed version to the host association by mail. The receipt of the form at your home association will trigger the immediate release of a standard letter from the home association to the host association confirming your status at the home association. Provided you are a member in good standing at the home association and all other details are in order to the satisfaction of the host association you will be issued a Special Authorization in the case of Quebec and a Special Exemption in the case of Ontario. Clearance for Incidental practice will be confirmed through the issuance of a letter to you from the host association, a copy of which will be sent to the home association for their file. It will specify the starting date for incidental practice and such other details as may be pertinent. Both associations have given a commitment to process applications for Incidental Practice on a 5 day turn around basis. There is no charge to apply for or receive clearance for Incidental Practice. Clearance is not guaranteed. PROCÉDURE DE DEMANDE D'AUTORISATION DE PRATIQUE OCCASIONNELLE In English La pratique occasionnelle est définie comme un exercice qui n'excède pas trois activités individuelles dans un (ou des) endroit(s) spécifié(s) durant une période de trois mois consécutifs à l'intérieur d'une période de douze mois. La pratique occasionnelle est permise suivant l'obtention d'une Autorisation spéciale au Québec ou d'une Exemption spéciale en Ontario. Tous les professionnels travaillant dans l'autre province devront compléter et soumettre un Formulaire de demande d'autorisation de la Pratique occasionnelle. Le formulaire bilingue est conçu pour vous permettre de fournir toute l'information exigée concernant votre personne et le travail que vous prévoyez entreprendre. Cette dernière information inclut le lieu, le nom du client et la date à laquelle le travail débutera. Une fois complété et signé, le formulaire doit être expédié accompagné d'une pièce d'identification récente par courrier, télécopieur ou courriel à votre association et l'association de la province hôte. Note : L'original signé devra parvenir à l'association hôte. Sur réception du formulaire, votre association d'origine transmettra à l'association hôte une confirmation de votre statut. En présumant que vous êtes un membre en règle de votre association et que les détails fournis suffisent à l'association hôte, une Autorisation spéciale vous sera émise dans le cas du Québec ou une Exemption spéciale dans le cas de l'Ontario. L'autorisation de la Pratique occasionnelle sera confirmée par l'association hôte par une lettre dont une copie sera également transmise à votre association. Cette lettre indiquera la date du début ainsi que tout autre détail pertinent. Les deux associations ont pour objectif de traiter les demandes d'autorisation de la Pratique occasionnelle dans un délai de 5 jours. Aucun frais n'est exigé pour émettre une autorisation de Pratique occasionnelle. L'obtention d'une autorisation n'est pas assurée. HOW TO APPLY FOR TEMPORARY PRACTICE En Francais Temporary Practice is defined as practice which exceeds Incidental Practice but does not exceed 12 months in duration and is related to a particular engagement. Temporary practice will require applying for a license in the host jurisdiction. Temporary practice licenses will be of one year duration and will be renewable for 2 additional years. Recurring practice in a fourth year will require full dual registration. To apply to undertake Temporary Practice a visiting practitioner will be required to complete and submit an Application for Temporary Practice form. This bilingual form will require that you provide basic information about yourself and the Temporary Practice assignment you are to engage upon, including the location of the work, the client, and the commencement date. Upon completion and signature, the form should be sent along with current photo ID by regular mail, fax or as an electronic document file in duplicate to both your home association and the host association in whose jurisdiction you intend to work. NOTE: if you fax or e-mail the form you must also send the original signed version by mail to the host association with the accompanying payment. The receipt of the form at your home association will trigger the immediate release of a standard letter from the home association to the host association confirming your status at the home association. In the case of an Application for Temporary Practice the home association will also automatically transfer copies of other pertinent material from your file, which is required to expedite acceptance for temporary licensure. Provided you are a member in good standing of the home association and all other details are in order to the satisfaction of the host association you will be issued a Temporary Permit in the case of Quebec and a Temporary License in the case of Ontario. Clearance for Temporary Practice will be confirmed by the host association as follows:
Both associations have given a commitment to process applications for Temporary Practice as quickly as possible and have set as a target a 15 day turn around. However, given that Temporary Practice does requires formal registration in the host jurisdiction and appropriate procedures must be followed, it may be that more than 15 days are required. To cover for any likely delays it will be the practice at both associations to issue clearance for Incidental Practice (provided all requirements for such practice are met) in the interim, while Temporary Practice applications are being processed. A processing fee of $100 plus applicable taxes will apply to each application for Temporary Practice. Annual dues for Temporary Licensure in both jurisdictions have been set at $200 plus applicable taxes for Temporary Practice, under the provision of the Quebec-Ontario Mobility Agreement. Those undertaking Temporary Practice in Quebec should be aware that an additional $22 per annum levy will be collected on behalf of the Office des Professions. This charge is required of all professionals in Quebec and is beyond the control of the OGQ. De plus, votre association transmettra tout autre document ou information pertinente dans votre dossier à l'appui de votre demande. En présumant que vous êtes un membre en règle de votre association et que les détails fournis suffisent à l'association hôte, un Permis temporaire vous sera émis dans le cas du Québec ou une Licence temporaire dans le cas de l'Ontario. L'autorisation de Pratique temporaire sera confirmée par l'association hôte comme suit :
Des frais de $100 plus taxes sont exigés pour traiter une demande d'autorisation de Pratique temporaire. Selon les termes de l'Entente bilatérale APGO/OGQ, la cotisation annuelle pour la/le Licence/Permis temporaire dans les deux provinces a été fixée à $200 plus taxes. En outre, l'Inscription au Tableau de l'Ordre des géologues entraîne le versement d'un montant annuel de $22 à l'Office des Professions. Ces frais sont payés par tous les professionnels au Québec et ne sont pas sous le contrôle de l'OGQ.
