Ontario’s New Civil Liability Regime: An Important New Development that could Impact Professional Geoscientists

All geoscientists in Ontario need to be aware of the following legislation that comes into effect on January 1, 2006 which significantly increases their exposure to class action lawsuits. The new Ontario legislation could enable investors (who acquire or dispose of securities on the exchange) to sue issuers, directors, trustees of investment funds, and those generating technical reports including geologists that are associated with inappropriate disclosures by issuers which have a significant impact on the market price of a security. APGO strongly encourages its membership to educate themselves of the potential risks associated with making public disclosures. APGO’s Communications Committee will revisit this legislation in the February issue of Field Notes.

The South Asian Earthquake of October 8, 2005 – An Eyewitness Account

On October 8, 2005 at 9:00 a.m., I was upstairs in a house in Lahore, Punjab Province when suddenly the steel grills in the window tinkled like an alarm clock. When the tinkling lasted more than a couple of seconds, I realized it was an earthquake and instinctively rushed downstairs and out onto the road. The ground ebbed and swelled under their feet as neighbours stood terrified on the roadsides. We felt muffled thuds under our feet and a low but distinct growl was heard that passed over in a general north to south direction. These ten seconds of terror felt like eternity.

Sometimes geologists are assigned a scope of work that seems virtually impossible to deal with under the current regulatory framework. The most difficult ethical cases occur when business related contractual agreements, restricted scope of work, tight timelines and budgets conflict with the geoscientist’s ability to diligently complete a review of the basic data that form the foundation of a reasonable mineral resource estimate and appropriately address any shortcomings. Given that a mining company’s principle assets are its mineral resources and reserves, due diligence, care and attention to the basic geological data ultimately form the underpinnings of good business decisions that protect the well being of the public...
